All Clientele of Wes Sounds Studio are required to read over this Policy and Terms agreement. By continuing to use our services, the Clientele hereby agrees with the following Policy and Terms below:

*Two days every week are assigned to be “Walk-In Days” meaning the studio will be operating and available for walk-in appointments on those days from opening time until the studio decides to close. Recording Studio Terms:
(Updated July 12, 2022)


 

  1. Only people allowed during active sessions are the individual artists or group members participating in the project (with the exception of driver, if client has to ride with someone else)

  2. No bargaining. The prices stated at the end of each session are finalized and CANNOT be reduced unless directed otherwise by Administration.

  3. Unless a reservation has been paid, the client has forfeited their appointment if over 15 minutes late to the booked appointment. If a reserve has been paid, the appointment will be open for reschedule or refund, if desired (with the exception of a non-refundable deposit)

  4. The Client must be fully clothed.

  5. Client WILL NOT RECEIVE finished project(s) until all payments/debts are paid in full for said project.

  6. Noise is to be kept to a minimum when studio microphone is live

  7. No pets allowed in the recording studio

  8. If the client has a firearm, it must not be loaded in the recording studio

  9. NO SOLICITING

  10. If Client is ill, please reschedule (refer to Policy Section VIII(8) subsection ii(2))

Business Terms and Policy

*This document is an official statement for the Terms and Policy of Wes Sounds Studio, on behalf of the Studio Staff AND the Clientele. By doing business with Wes Sounds Studio, you are hereby agreeing to the following terms and policy:

 

SECTION I: Customer Satisfaction:

 

  1. Customer satisfaction is a PRIORITY in our establishment. Customers are entitled to a completed project(s) to the best skills provided by the assigned Engineer(s) before the service is considered completed and invoice(s) issued to the client.

 

SECTION II: Booking/Walk-in Appointments, Deposits & Reservations:

 

  1. Wes Sounds Studio operates between the hours of 8am to 1pm from Monday through Friday. The client can book appointments or walk-in if Wes Sounds Studio is available at the time of arrival.

    1. The client can ONLY book appointments with Wes Sounds Studio outside of the normal operating hours if there is an available engineer at the time. WALK-IN’S NOT AVAILABLE OUTSIDE OF BUSINESS HOURS. The client has to contact Wes Sounds Studio ahead of time for proper preparation.

    2. Weekends and Holidays are available for BOOKING ONLY(Walk-in’s not available) with extra taxes included with the original rates. Tax percentage will vary with the assigned Engineer(s)

  2. For some booking services(i.e, 3+ hour session or Photo/Video Shoot), the client will be required to pay a NON-REFUNDABLE DEPOSIT for security reasons. The deposit amount will vary depending on the clients desired service(s) and the assigned Engineer(s). If required, the deposit MUST BE PAID in order to book an appointment for the desired service(s)

  3. For services that DO NOT require a deposit, the client can optionally pay for a RESERVATION for their booked appointment. The reservation will be half of the estimated rate and/or price and is refundable if canceled. Reservations will secure the clients appointment from being filled by another appointment/walk-in.

    1. In the case of a Fixed Rate, if the final invoice can be created BEFORE the service begins, the client can optionally pay in full instead.


 

SECTION III: Charges for Time & Equipment Usage:

 

  1. Wes Sounds Studio’s Rates apply to any individual Artist OR Band/Group that is participating in the service.

 (i.e, A hip-hop artist comes to record vocals in a studio and brings someone to feature on the project. Both individual artists will be billed. If a music duo, group, or band come to a studio to record as one name, they will be billed together. But if EACH MEMBER CAME SEPARATELY, THEY WOULD BE BILLED SEPARATELY)

  1. The Hourly Rate is charged to the clients invoice for every completed AND uncompleted hour on the Engineer(s) time clock. (time keeping methods vary depending on assigned Engineer(s)) (i.e, If the client has been in a session for 1 hour and 30 minutes, they will be billed for 2 hours)

    1. In the situation of hourly rates, the client is only charged for the time during which the equipment is being operated on. (i.e, Audio/Video Recording, Revisions, etc.)

    2. In the situation of Audio Recording, the client is NOT CHARGED for mixing time outside of the completed session. This does NOT include mixing DURING the session (i.e, client wants the engineer(s) to mix before they continue recording their session) This DOES NOT include Revisions.

  2. In the Situation of Fixed Rates, The client is charged a down payment for the project(s) OR an initial (non-refundable) deposit, with additional taxes as the mentioned project(s) develops more time and work. If the client is satisfied with the base charge and project(s), then the service(s) and transaction(s) can progress to completion. Taxes will be applied to the project for every revision desired by the client.

 

SECTION IV: Completion of Payment and Service(s)

 

  1. Completion of payment in full is required for files/projects to be transferred to the client. If failure to pay, the Studio has all rights to withhold and use any intellectual property and/or royalties earned from the files/projects. If the client fails to complete the payment for their service(s) within a 30 day period, all rights to the client are revoked and left up to Wes Sounds Studio.  

  2. After the payment is completed, the client will be issued their project(s) and/or file(s) however in their easiest convenience, along with a paper copy receipt and an Invoice via email. These documents are kept in our records indefinitely for insurance purposes, and the clients digital records can be accessed upon request by the client only(Exception of Legacy Member/Immediate Family Member of client if client has deceased after time of service)

 

SECTION V: Copyrights and Ownership

 

  1. Initially, any rights to any media and/or intellectual property created by Wes Sounds Studio are reserved to Wes Sounds Studio. This means that until an agreement has been fulfilled, the client is only reserved limited rights to their project(s), file(s), and/or product(s). This DOES NOT INCLUDE any piece of media and/or intellectual property outsourced or obtained outside of this studio (I.e, a “ripped beat” from a website or an instrumental purchased from a third party)

  2. Once the session(s) and service(s) are completed, copyrights of the media and/or Intellectual Property will be transferred to the client. Wes Sounds Studio, however, will still own the masters tied to the clients Service(s) and Project(s) (This DOES NOT transfer ANY copyrights and/or usage rights from any other party outside of Wes Sounds Studio)

    1. A written, signed, and witness-signed agreement can be initiated by Wes Sounds Studio OR the Client to obtain ownership of the clients master project(s) and/or file(s) tied to their services. Afterwards, Wes Sounds Studio will no longer have rights to the entire Project(s) tied to the client. Details will vary upon the agreement between Wes Sounds Studio and the client.

  3. Wes Sounds Studio is NOT in ANY WAY to be held liable for Copyright/Ownership Violations pertaining to any media and/or intellectual property outsourced or brought into Wes Sounds Studio by the client(I.e, a “ripped beat” from a website or an instrumental purchased from a third party). The Client is to be held liable and will be responsible for any and all actions taken against their violation.

  4. ANY distribution, publishing or general & promotional use of Wes Sounds Studio’s media and/or Intellectual property unauthorized by Wes Sounds Studio and/or its legal representatives can result in legal action. All use of Wes Sounds Studio’s media and/or Intellectual property must be authorized in a written in a signed agreement by both and/or all parties.

 

SECTION VI: Damages and Reparations:

 

  1. ANY and ALL damages done by the client during their time and service(s) at Wes Sounds Studio WILL BE HELD ACCOUNTABLE BY THE CLIENT. The costs of the damages and reparations caused will be added to the clients final invoice. If the client fails to make ANY progress towards reparations within 30 days, legal action can be taken. The client is responsible for any costs towards reparations and/or replacement of damaged property.

    1. Arrangements towards reparations can be altered or customized by AND ONLY BY the Administrator and/or the legal representative(s) of Wes Sounds Studio. NO OTHER INDIVIDUAL IS ALLOWED TO MAKE ARRANGEMENTS.

 

  1. During the process of reparations from the client, Wes Sounds Studio is reserved to all rights of the media and/or intellectual property being created during the event in which the damages were made, if any. Wes Sounds Studio will release the necessary rights back to the client once reparations are paid in full.




 

SECTION VII: Refunds & Reimbursements:

 

  1. Wes Sounds Studio has a NO REFUND POLICY for ANY and ALL fulfilled services. If the client leaves the establishment after receiving their Project(s) and/or File(s), they are no longer eligible to refund their service(s)

    1. The client is NOT ELIGIBLE for a refund from ANY product purchased from the website/online store.

  2. Services that were never received or carried out after 30 days are eligible for a refund to the client(with the exception of Non-refundable deposits).

    1. After 30 days, a refund becomes optional and not mandatory. If the client desires to keep their appointment and reschedule this is acceptable.

  3. If the client volunteers any equipment or physical property to the studio for use in their services, Wes Sounds Studio is held liable for any reimbursements to damages caused by any staff member of Wes Sounds Studio, and is held responsible by a written agreement signed by both parties to acknowledge the responsibilities, use and credits of the clients equipment.

    1. If the client is the cause of their own equipment and/or property, THE CLIENT is responsible for their own equipment/property.

 

SECTION VIII: Sickness & Wellbeing // COVID-19 Prevention

 

  1. If the client is experiencing ANY contagious symptoms of ANY flu, virus, or other sickness, the client must wait to return once they no longer experience these symptoms. 

    1. The client is NOT REQUIRED to wear a face mask or any form of face protection to the establishment. It is very difficult to record vocals through a face mask.

    2. The clients appointment will be rescheduled or refunded if desired (with the exception of a Non-refundable Deposit)

    3. If the client tests positive for COVID-19, client is recommended to follow CDC instructions and quarantine themselves for 2 weeks, then the client can return if they no longer test positive for COVID-19. ANY STAFF MEMBER within a close vicinity of the client during sickness MUST GET TESTED and follow the same steps from the CDC if tested positive.

    4. Any allergies the client may have that could possibly interfere with their service(s) need to be made known to the assigned Engineer(s) for proper preparation if possible.
